Article IV, Section 3, Clause 1 of the Constitution gives Congress the power to admit new states into the Union. Since the founding of the United States in 1776, the number of states has grown from the original 13 to the current 50, and each new state is admitted on an equal footing with existing states.
According to Article I, Section 8 of the Constitution, Congress exercises “exclusive jurisdiction” over a federal district that is not part of any state. Prior to the passage of the District of Columbia Home Rule Act of 1973, which transferred certain congressional powers to an elected mayor and council, the District had no elected local government. However, Congress retains the power to review and repeal laws created by the Council and to intervene in local affairs.
Because it is not a state, the district does not have state recapture. However, since 1971, its residents have been represented in the House of Representatives by a non-voting representative.
